Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Drake Realty, owned and operated by Braxton Drake in the Commonwealth of Kentucky (“DrakeTube”, “we”, “us”). They govern your use of the DrakeTube website and services (the “Service”). By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our Community Guidelines.

1. Who can use DrakeTube

You must be at least 13 years old. If you are under 18 (or the age of majority where you live), you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms. You must be at least 18 to request payouts. You may not use the Service if we have previously banned you.

2. Your account

Give accurate information, keep your password private and tell us right away at contact@draketube.tv if you think your account was accessed without permission. You are responsible for activity on your account. We may require you to confirm your email address before you can upload or comment.

3. Your content

You keep ownership of the videos, thumbnails, comments and other material you post (“Your Content”). By posting it, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, transcode, display, distribute and promote Your Content in connection with operating and improving the Service. This license ends when you delete Your Content, except for reasonable backup copies and content others have already shared or that we must keep for legal reasons.

You promise that you own Your Content or have all rights needed to post it (including music, footage and the likeness of people who appear in it), and that it follows these Terms and the Community Guidelines.

4. Rules

Follow the Community Guidelines. Don’t break the law, infringe others’ rights, upload malware, scrape or overload the Service, manipulate views, likes or earnings, or try to get around moderation or bans.

5. Moderation and termination

We may review, hide or remove content and suspend or terminate accounts that we believe break these Terms or the Guidelines, or create risk or legal exposure for us or others. We may report illegal content (including child sexual abuse material, which we report to NCMEC) to the authorities.

6. Copyright

We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act. See our Copyright / DMCA page. We terminate the accounts of repeat infringers in appropriate circumstances.

7. Creator monetization, tips and payouts

Monetization features are in an early stage. Card payments for tips and automatic payouts are coming soon and are not active yet. Until then, tips are recorded as pledges only and no card is charged, and payout requests are records reviewed by our team. Estimated earnings shown in Creator Studio are estimates, not amounts owed, until confirmed in writing. When payments launch, additional payment terms (including those of our payment processor) will apply. Payout eligibility rules, the platform fee and the minimum payout amount may change. You are responsible for your own taxes.

8. Third-party services

We use service providers to run the Service (for example, video hosting and delivery, email delivery and, later, payment processing). Their services may be subject to their own terms.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT ALLOWED BY LAW. Off-road and motorsport videos can show dangerous activities; don’t try to copy them. We don’t endorse user content.

10. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, DRAKE REALTY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, AND OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. 11. Indemnity

You agree to defend and hold harmless Drake Realty and Braxton Drake from claims arising from Your Content or your breach of these Terms.

12. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in [COUNTY], Kentucky, unless applicable law requires otherwise. [ATTORNEY: consider arbitration / class-action waiver.]

13. Changes

We may update these Terms. If a change is material, we’ll give notice on the site or by email before it takes effect. Continuing to use the Service after that means you accept the new Terms.
